14.1 What role do the explanatory memoranda for the specimen decree (MRVO) and the accreditation ordinances of the Federal States play, and what does it mean if no explanatory memorandum exists in a Federal State?
The explanatory memoranda to the state ordinances can be used as an aid to interpretation. In the absence of a published justification for the state ordinance, the justification for the MRVO is relevant for the interpretation by the Accreditation Council, provided that the contents of the state and specimen decrees are the same (see the overview here). Irrespective of this, the principle of overriding state law applies.
